Read the facts and ask: has one party objectively shown a present willingness to be bound on these terms, or are they just inviting others to make an offer?
Is this a shop display, advertisement, auction, tender, quotation, or online listing? Classify the setting before deciding the legal effect.
Look for definite language, fixed terms, and commitment language. Does the wording leave room for acceptance to create a contract immediately?
If the statement promises a reward or benefit for doing an act, ask whether it is a unilateral offer accepted by performance rather than by promise.
If the facts involve an auction or tender, identify who is inviting bids and who is making the offer, and note when acceptance occurs.
Finish by saying who, if anyone, made the offer, who could accept it, and whether a contract was formed on the facts.
